Patrick Norton's practice focuses on intellectual property and patent infringement litigation. Patrick represents plaintiffs and defendants in cases involving a wide variety of technologies, including fluid pumps, printers, televisions, semiconductor packaging, and electronic fuel injectors. Patrick has extensive experience in medical device litigation. In addition to patent litigation, he has handled cases involving breach of contract, fraud, tortious interference, unfair competition, misappropriation of trade secrets, trademark infringement, and noncompetition agreements. He has litigated in both state and federal courts and also has handled arbitrations.
Patrick's recent matters include representing DePuy Spine in a patent infringement case involving spinal implants. Patrick was involved in an initial jury trial that resulted in an award of $26 million for one product and a second jury trial that resulted in an award of $179 million for a second product after affirmance by the Federal Circuit. The $179 million award is one of the largest patent infringement verdicts affirmed by the Federal Circuit.
Patrick represented DePuy Orthopaedics in an arbitration brought by a surgeon claiming entitlement to more than $10 million in damages on claims of breach of contract, fraud, misappropriation of trade secrets, and conspiracy. A defense verdict was rendered by a panel of three arbitrators following a six-day trial.
He also represented Molten Metal Equipment Innovations in a patent infringement action relating to molten metal pumps that resulted in an award of $8 million after affirmance on appeal.
Patrick is a member of the American Bar Association and the Ohio State Bar Association.
