David Rutkowski represents clients in a variety of litigation matters, including toxic tort, products liability, RICO, unfair trade practices, and trademark and copyright infringement claims, with a focus on toxic tort and products liability litigation. His practice also includes internal investigation and counseling on matters involving Foreign Corrupt Practices Act and other white-collar crime.
David currently represents Wyeth Pharmaceuticals in ongoing nationwide products liability litigation involving Wyeth's antidepressant drug, Effexor. He recently earned a unanimous defense verdict for Wyeth against wrongful death allegations involving failure to warn and misrepresentation claims, the first case of its kind against the antidepressant industry to go to trial in more than six years. David was also extensively involved in defending IBM in cases brought in California and New York by more than 200 current and former employees alleging various adverse health effects due to workplace exposure to chemicals and was part of the team that earned a unanimous jury verdict for IBM in the first of these cases to go to trial.
