Mr. Gustin focuses his practice on real estate law, providing a depth of experience in deal-structuring, efficient execution, confident and direct management of the deal, a network of contacts, and a collaborative approach to closing the transaction.

Real Estate Finance

Mr. Gustin has extensive experience representing lenders and borrowers in a wide range of financing transactions for a variety of real estate projects including multifamily, office, industrial, retail and warehouse projects.  He is recognized in particular for his work in multifamily housing finance, where he closes and delivers loans secured by multifamily projects to secondary market investors such as Freddie Mac and Fannie Mae.  He has developed relationships with these investors and proficiency in understanding constantly changing program requirements and documentation.  He provides a full range of services specifically relating to multifamily housing, whether the product is market-rate or affordable, senior housing or assisted living facilities, condominiums or cooperatives, new construction or rehabilitation.  He has closed and delivered hundreds of conventional term loans, as well as many bond credit enhancements, forward commitment and construction loans, revolving lines of credit, subordinate and mezzanine loans and loan pool transactions, involving projects across the country.

Real Estate Leasing, Acquisitions and Dispositions

Mr. Gustin represents landlords and tenants in negotiating and preparing lease documentation for retail, office, industrial and warehouse space.  He also works with buyers and sellers in all phases of acquisition and disposition of residential and commercial real estate projects, from negotiations, to due diligence, to document preparation, to closing.

Real Estate Development

Mr. Gustin represents clients in the development of residential subdivisions, including single-family and multifamily housing, condominiums and townhouses.  In so doing, he works closely with use restrictions, easements, builders' agreements and unique subdivisions and plats.

Real Estate Title Resolution

Mr. Gustin represents many types of clients in identifying and resolving title and survey issues and negotiating title insurance coverage.

  • Representation of lender on a $250,000,000 revolving credit loan secured by various multifamily projects in the States of California and Washington.
  • Representation of lender on a $100,000,000 revolving credit loan secured by various multifamily projects in the States of California and Washington.
  • Representation of lender on a loan pool transaction totaling over $127,000,000 and involving 31 properties in 15 different states, with the loans in each of the 3 pools cross-collateralized and cross-defaulted. 
  • Representation of lender in connection with a construction loan made from the proceeds of tax-exempt senior bonds and taxable subordinate bonds, and the provision of liquidity support and credit enhancement thereof, for the construction and equipping of a multifamily project in the State of Texas. 
  • Representation of lender on a $3,350,000 construction/mini-perm loan for the construction and equipping of an engineering firm headquarters in the State of Minnesota. 
  • Representation of tenant in negotiating and drafting a commercial lease for a sports medicine and physical therapy clinic in the State of Wisconsin. 
  • Representation of client on the sale of an industrial/office real estate project and concurrent purchase of vacant land for commercial development in the State of Minnesota.
