In 1987 the computer made it possible to generate legal documents efficiently and inexpensively. Prior to that, we had our paralegals typing all our documents on word processors. We saw the real estate values going up and up in California and the wills and probate system becoming too burdensome and expensive for the average family. We started doing seminars on the value of the Living Trust. Trust have been around since the 1500’s, yet most people were not very familiar with them. The Wills and Last Testaments were the way most people passed their estate to their heirs.
The expense and time constraints in California were becoming more and more outrageous. The average probate takes 2 to 3 years to resolve because the courts are so backed up. The Wills are public documents and with people constantly contesting them, it not only slowed the process down, but added unnecessary expense to the estate. The logical answer was to get a Revocable Living Trust.
This was not probated at all, and it is a private document that could not easily be contested. Fraternal organizations such as the Moose Lodges, American Legion Posts, the VFW Posts, The Elks Clubs invited us to come and speak to their membership concerning the Living Trust. Until 2001 we sold these trusts to their membership at reduced costs, with a promise that we would be there for the rest of their lives.
Today we have sold over 35,000 trusts and have had over 22,000 deaths. Each and every time, the trust has performed as we assured them it would. Ultimately, we have saved tens of thousands of dollars in probate fees. As well as assisting the successor trustees and beneficiaries in distributing the wished of the trustors.
Creating your family trust takes a few simple steps and can preserve and protect your assets for your loved ones.
Our firm philosophy is based on four life goals for our clients:
We have an unsurpassed system which helps you with the above. When you plan your estate with our office, we track your goals and keep you up to date with the latest laws affecting your trust and estate plan. We give seminars throughout CA monthly to explain Living Trusts. At the seminar you can purchase a trust inexpensively. We give you a worksheet to assist you in gathering all the needed information. Once you send us this information, we generate your trust and send it out within 30 days. We send a notary to your home to notarize your documents free of charge. We keep you informed of new updates through our newsletters and customer appreciation seminars, yearly. We offer one amendment per year at no charge. We do that so you will keep your trust current and updated to reflect your wishes. The attorneys are available to you and your family to discuss your estate plan without incurring any further fees.
We are also able to review old trusts prepared by other law firms and bring them up to date or amend them. Please let us know in advance if you have an existing trust which needs a review. As long as a trust is revocable, it can be amended and updated.
Normally, the family trust provides for the method of revocation or amendment to the trust. These requirements have to be met exactly for the amendment to be effective.
