Doug Burton is a partner in the Real Estate Practice Group. He joined the firm in 1995. His practice focuses on all aspects of real estate law, including private equity investment, development, acquisitions, dispositions and leasing. He serves as counsel for a broad range of clients, including pension fund advisors, Fortune 50 corporations, developers and non-profit institutions.

Practice

Mr. Burton has represented investment managers in well over a billion dollars of joint ventures, financings, acquisitions and dispositions. His recent projects include the representation of a pension fund investment advisor in the formation and financing of an $80 million partially seeded joint venture to acquire retail properties on a national platform; the disposition of a $110 million portfolio of industrial properties across different funds in three states, including the establishment and transfer of a municipal development authority bond arrangement; and the portfolio sale of twelve assisted living facilities, across multiple funds, for $300 million. He also recently has represented investment managers in the modification and work-out of multiple troubled loans, generally of a size between $25 million and $30 million, secured by multi-family properties, senior living facilities and office properties in various states; as well as advised investment managers with the evaluation and structuring of acquisition strategies for distressed loans and the properties secured thereby, both inside and outside of foreclosure, particularly in the senior housing sector. Mr. Burton’s recent retail projects include representation of Lowe's Home Centers in the acquisition, leasing and development of numerous sites throughout the Northeast. Other projects include the representation of a developer in the acquisition, financing, development and operation of a nationally listed historic site as a $100 million, 300 room luxury hotel, including the negotiation of development and joint venture agreements with a pension plan equity partner, implementation of a historic tax credit structure, and the negotiation of a ground lease with a fee owner and space leases and management agreements with the signature bar, restaurant and hotel manager.

His experience also includes the acquisition and disposition of multi-family residential apartment complexes, both for cash and in connection with REIT and partnership strategies; and the acquisition and development of low income residential housing with low income housing tax credits and both hard and soft mortgage financing.

Mr. Burton's leasing experience includes office, retail and biotechnology/life science space from both the landlord's and tenant's perspectives, including the lease-up of a 275,000 square foot multi-tenant office building.

Speaking Engagements

Since 2001, Mr. Burton has been a frequent lecturer and guest lecturer at the MIT Center for Real Estate, both conducing full-day professional development seminars and teaching graduate level courses. Most recently, he was a guest lecturer speaking about distressed loans for two classes in April 2011, for a course entitled “Real Estate Ventures II: Negotiating Leases, Financings & Restructuring.”

Mr. Burton has co-taught professional development seminars and spoken as a guest lecturer for graduate level courses at the New York University Schack Institute of Real Estate since 2009, most recently as a guest lecturer speaking about commercial real estate workouts in February 2011.

He has also been regular guest lecturer at Columbia University’s MSRED Program since 2009, most recently speaking about distressed loans and capital arrangements in October 2011.

Mr. Burton is a member of the Pension Real Estate Association and the International Council of Shopping Centers. He is also a member of the American Bar Association, New York State Bar Association, Massachusetts Bar Association and Boston Bar Association.

Community Involvement

Mr. Burton is the president of his alumni class at Amherst College, and past member of the board of directors of the Mountain View Association.
