Kevin Marshall assists clients with analysis, strategy, and advocacy involving novel or complex legal issues at all levels of federal and state courts, prelitigation including internal investigations, and before regulatory agencies. This has included appeals as well as dispositive and other motions at the trial level in both civil and white-collar cases.

Kevin's matters have involved, among other areas, the Constitution, RICO, civil and criminal fraud, witness tampering, wiretapping, defamation, reckless manslaughter, bankruptcy, preemption, civil and criminal procedure, privilege, and federal habeas corpus.  Matters under the Constitution have included the First Amendment, Second Amendment, takings and due process, and the Double Jeopardy, Speedy Trial, and Confrontation Clauses.  Kevin was part of the Jones Day appellate team representing the National Federation of Independent Business in its challenge to the constitutionality of the Patient Protection and Affordable Care Act before the United States Court of Appeals for the Eleventh Circuit and the United States Supreme Court.  He also has advised on and briefed legal issues related to consumer products, including the implementation of and compliance with the Consumer Product Safety Improvement Act of 2008 and its amendments.

Before joining Jones Day in 2007, Kevin was a deputy assistant attorney general in the U.S. Department of Justice's Office of Legal Counsel. At the DOJ he provided authoritative written legal opinions and other legal advice to The White House, attorney general, and other executive branch officials on the Constitution, treaties, international law including the law of war, and a wide variety of federal statutes and regulations. In connection with these duties, he also testified three times before Congress.
