Sean Malone's practice focuses on a variety of commercial litigation matters and government investigations, including fraud, breach of contract, antitrust, and False Claims Act cases. He also advises corporations on compliance with U.S. trade controls and economic sanctions.
Sean has experience with all phases of litigation, from discovery through trial, settlement, and appeal. His trial experience includes cross-examination, assisting with opening statements and closing arguments, and preparing witnesses for direct examination. He also has spent significant time taking and defending depositions, writing briefs, and resolving discovery disputes.
The major representations that Sean has been involved in include: a global energy supplier in a dispute before the Court of Federal Claims arising from the divestiture of a U.S. strategic petroleum reserve, health care providers in Sherman Act lawsuits alleging conspiracies to suppress nurse wages, a pharmaceutical company accused of False Claims Act violations, and the creditors' committee of a bankrupt auto supplier in a fraud claim against the seller of a failing business.
In addition, Sean has successfully represented many pro bono clients, including an asylum petitioner in Immigration Court, a soldier appealing an unfavorable disability ruling by the U.S. Army's Physical Evaluation Board, and a criminal defendant accused of felony drug possession in Maryland state court. Sean regularly volunteers at the D.C. Bar Advice and Referral and Landlord-Tenant Clinics.
