Melissa H. Lambert is of counsel in the firm's Honolulu office and a member of the Litigation & Alternative Dispute Resolution Practice Group. She concentrates her practice in commmercial litigation, employment litigation, and trust and estate litigation. In addition, Ms. Lambert counsels employers in all aspects of employment law.
Representative Matters
Commercial/Business Disputes Represented company in prosecution of claims for fraud, unjust enrichment, and breach of contract. Successfully obtained injunction for breach of non-competition agreement.
Workplace Violence Obtained temporary restraining order and preliminary and permanent injunctions to address workplace violence concerns.
Employment Litigation Assists employers in responding to charges of discrimination, including sex, race, national origin, age and disability, filed with federal and state agencies. Defends clients against wrongful discharge, discrimination, harassment, whistleblower, and retaliation lawsuits filed in federal and state courts.
Sexual Harassment Assist employers with investigation of sexual harassment complaints and fashioning appropriate remedial measures for complainants and harassers.
Labor and Employment Advice. Advises employers regarding compliance with federal and state employment laws, wage and hour issues, discipline and discharge, personnel policies and procedures, corporate restructuring and downsizing issues, and successor employer liability. Assist clients with drafting employee handbooks, job descriptions, and employment contracts.
Prior Work Experience
Prior to joining Carlsmith Ball, Ms. Lambert served as an extern to the Honorable David Alan Ezra, Chief United States District Judge for the District of Hawaii.
