Mike Tomasulo's practice focuses primarily on intellectual property litigation and counseling for a wide array of sophisticated technology clients. Most recently, Mike has been lead counsel or co-lead counsel in patent, trade secret, copyright, and trademark litigation, as well as in two arbitrations involving breach of contract cases, including an international dispute litigated simultaneously in Canada and in the United States before the International Center for Dispute Resolution. Mike's patent cases have involved a diverse variety of technology, including flash memory controllers, gamma ray inspection equipment, high-brightness LEDs, computer hardware emulation, mechanical equipment, medical devices, and biotechnology. Mike has significant experience with patent litigation before the U.S. International Trade Commission.
Mike was recently co-lead counsel for Activision Publishing in a theft of trade secret case regarding the phenomenally successful Guitar Hero™ video game franchise. In that case, Mike was retained after Activision learned that several Activision employees, a former consultant, and a competitor were conspiring to usurp a confidential and trade secret corporate opportunity for Activision's Guitar Hero™ franchise. Mike worked with the client and computer forensic specialists to locate electronic evidence of the conspiracy from the employees' workstations. With this evidence, Jones Day obtained broad temporary restraining orders, evidence preservation orders, and orders for expedited discovery against all defendants, effectively halting defendants' plans.
Mike is a court-appointed attorney settlement officer for the U.S. District Court for the Central District of California. Mike frequently speaks and publishes on intellectual property topics and is a member of the Executive Planning Committee for the University of Southern California's Intellectual Property Institute.
