Mr. Johnston’s practice focuses on products liability law, with an emphasis on pharmaceutical product liability litigation and on handling insurance coverage disputes for clients in many different industries. Mr. Johnston coordinates serial litigation on behalf of the Firm’s pharmaceutical clients and has helped clients successfully pursue and respond to discovery in significant multi-party litigation. He represents clients in both state and federal courts in actions seeking coverage for environmental liabilities, asbestos-related claims, defamation, errors and omissions by insurance agents, and various other business torts. He also consults with clients regarding the pursuit of insurance proceeds under solvent and insolvent schemes of arrangement. He has written and spoken on numerous issues relevant to insurance coverage, including issues of fidelity insurance and coverages available for e-commerce enterprises.
Mr. Johnston also has pursued litigation in connection with government contracts, including Winstar-related claims, nuclear-spent-fuel claims, and claims for the taking of property by the government without just compensation. He also has significant experience representing clients in commercial business disputes, including suits arising out of the telecommunications and e-commerce industries. Mr. Johnston has experience in all phases of trial and appellate litigation.
Mr. Johnston served as a member of the George Washington Law Review. In 2003, he judged the finals of the George Washington University Law School Cohen & Cohen Mock Trial Competition.
