Howard Sidman advises policyholders in complex insurance coverage disputes for a variety of underlying liabilities, including catastrophic property damage and resulting business interruption, toxic torts, ERISA class actions, and securities fraud cases. His substantive experience includes: first-party property damage insurance claims, business interruption claims, directors and officers (D&O) claims, fiduciary liability claims, and toxic tort claims. Through litigation, arbitration, and negotiation against insurance companies, he has recovered well over a half a billion dollars for policyholders. Howard also advises in the negotiation of terms and conditions of policies with insurance companies.
In addition to his insurance coverage work, Howard's civil litigation experience includes representations relating to securities class actions, complex commercial class actions, and contract disputes. Recently, he successfully opposed a motion for class certification in a case brought against Macy's department stores seeking to certify a class of vendors who sold goods to Macy's over a seven-year period for two separate breach of contract claims under the Uniform Commercial Code. Howard also assisted a major railcar manufacturer with the successful resolution of contractual disputes with various state governments. Howard's products liability experience includes representations relating to paints, chemicals, and sterilization devices for medical equipment.
Howard is a member of the American Bar Association (Litigation Section and Committee on Insurance Coverage Litigation) and the New York State Bar Association (Torts, Insurance & Compensation Law Section).
