Colin Rushing is counsel in the Litigation Department at WilmerHale, and a member of the Intellectual Property Litigation Group. Mr. Rushing's practice focuses on intellectual property, media law, and cyber law.
Practice
Mr. Rushing has represented numerous clients in federal and state trial and appellate courts throughout the country. He has represented technology and media companies in cases involving interactive service provider liability for third-party content, defamation, trademark infringement, copyright infringement, privacy, First Amendment and communications law. Mr. Rushing has also represented technology and media companies involved in complex patent disputes in federal courts and before the International Trade Commission.
Recent Highlights
Mr. Rushing has represented numerous clients, either as defendants or amici, in multiple cases resulting in published decisions regarding interactive computer service provider liability, including Carafano v. Metrosplash, 339 F.3d 1119 (9th Cir. 2003); Green v. America Online, 318 F.3d 465 (3d Cir. 2003); Gentry v. eBay, 121 Cal. Rptr. 2d 703 (Ct. App. 2002); and Noah v. AOL Time Warner, 261 F. Supp. 2d 532 (E.D. Va. 2003) (affirmed by an unpublished per curiam decision).
Mr. Rushing was a member of the team of litigators that recently successfully represented the relator in a False Claim Act case in the United States District Court for the District of Columbia, helping the United States to win a verdict of $103 million against several defendants who had participated in a bid-rigging conspiracy. He was also a member of the litigation team that won a major copyright infringement case in the Southern District of Florida and in the United States Court of Appeals for the Eleventh Circuit.
Professional Activities
Mr. Rushing has co-authored several articles about interactive computer service provider liability, including articles that have appeared in the MediaLaw Letter and the ABA's Communications Lawyer.
