Henry Gu is a counsel in the firm's Intellectual Property Department. He joined the firm in 2005. Mr. Gu's practice includes patent prosecution, litigation, due diligence and opinion work in the fields of pharmaceuticals, life sciences, chemistry, and materials science as well as China-related IP counseling.
Practice
Mr. Gu serves as counsel to many sectors of the chemical, pharmaceutical, biotechnology and clean energy industries, including start-up, mid-size, and well-established, multi-national companies. Mr. Gu has extensive experience in the areas of patent prosecution, IP counseling, patentability assessments, freedom-to-operate, competitive landscape analyses, due diligence, and non-infringement and invalidity opinion. He also assists clients with all aspects of their IP rights in China, including procurement and enforcement of patent rights. Mr. Gu utilizes the experience he has in core IP areas to represent clients in IP litigation and arbitration in the areas of pharmaceuticals, chemical engineering and LED technology, including Hatch-Waxman litigation related to pharmaceutical products. He is also experienced in conducting pre-litigation investigations for patent infringement.
Prior to joining WilmerHale, Mr. Gu held an in-house position at Bristol-Myers Squibb Company in Princeton, NJ, where he was responsible for drafting and prosecuting US and foreign patent applications and provided support for patent opinion and IP strategy. Before attending law school, Mr. Gu was a research scientist for Bristol-Myers Squibb, where he designed and synthesized novel organic molecules in numerous drug discovery programs. He is an experienced inventor and has ten issued US patents. Mr. Gu has published extensively in peer-reviewed journals, such as Bioorganic & Medicinal Chemistry Letters, Journal of Medicinal Chemistry, Tetrahedron Letters, Organic Letters and Synlett.
While in law school, Mr. Gu was editor of the Rutgers Law Review and author of Note, “The Hatch-Waxman Act and the Declaratory Judgment Action: Constitutional and Practical Implications,” 57 Rutgers L. Rev. 771 (2005). While in graduate school, Mr. Gu taught General Chemistry as a teaching assistant at the University of Pennsylvania.
Professional Activities
Mr. Gu is co-chair of the Boston Bar Association's International Intellectual Property Law Committee, and also serves as president of the Chinese American Intellectual Property Law Association. He is a member of the American Intellectual Property Law Association, Boston Bar Association, Boston Patent Law Association and American Chemical Society.
