Anthony Mustillo drafts and prosecutes United States and foreign patent applications in the mechanical arts, including medical devices (stents, joint prostheses, bone plates, injection devices, metered dose inhalers, and endodontic instruments), pens, mechanical pencils, razors, fuel injection systems, papermaking fabrics, woven preforms for composite structures, and woodworking tools and equipment. He has prosecuted more than 400 applications and drafted approximately 50 applications.
Anthony renders freedom-to-operate, patentability, noninfringement, and invalidity opinions for utility and design patents. The majority of the opinions have been directed to stents, pens, mechanical pencils, and razors.
Anthony also has been involved in European opposition proceedings, working closely with European attorneys to develop arguments for use in the proceedings, and has been involved in interferences preparing documents to provoke interferences and developing arguments for use in the interference proceedings.
Additionally, Anthony performs intellectual property due diligence for M&A transactions, including review of intellectual property portfolios and transaction documents. He also reviews and drafts patent and trademark licensing agreements. Most recently, he performed intellectual property due diligence for Procter & Gamble for the merger of the Folgers coffee business with the J.M. Smucker Company ($3.3 bn value).
Prior to law school, Anthony worked for the U.S. Army Corps of Engineers where he was a project engineer on multiple Superfund remediation sites involving the removal of radiological contamination from residential neighborhoods.
