Melendez, Javier Rivera

Dan McMillan's practice focuses on complex commercial, business, and construction litigation. As co-chair of the Firm's global construction practice, he represents owners, design professionals, and contractors in large construction disputes and in negotiating and drafting contracts for construction projects. He has handled complex contractual disputes and claims involving federal and state false claims acts, RICO statutes, and antitrust laws. Dan has substantial trial, motion, and appellate experience, as well as extensive experience with domestic and international ad hoc and administered arbitrations.

Dan is a member of the Disputes Review Board Foundation, the Association of International Petroleum Negotiators, and the American Bar Association Forum on the Construction Industry (Steering Committee for Dispute Avoidance and Resolution, 2003-2008 and Technology Committee, 2008-present). He is on the executive board of the Los Angeles Economic Development Corporation, served as an adjunct professor at Loyola Law School teaching appellate advocacy, and has been an instructor for the National Institute of Trial Advocacy. Dan currently serves on the California Commission on Judicial Nominees Evaluation, which evaluates judicial candidates and reports to the governor.

A frequent speaker and writer on issues of interest to the construction industry and the legal profession, his many publications include: "Truth or Consequences: California's False Claims Act," L.A. Daily Journal (Oct. 21, 2009); "Drafting Dispute Review Board Provisions" in Construction Checklists: A Guide To Frequently Encountered Construction Issues (ABA Publishing 2008); and "Prequalification of Contractors by State and Local Agencies: Legal Standards and Procedural Traps," 27 Const. Law. 21 (Spring 2007).
