STEVE MCKINNEY is a Partner and Chairman of the Environmental and Natural Resources section of Balch & Bingham LLP. His practice includes regular representation of private companies and coalitions in the following areas:
· Environmental Permitting - Clean Air Act (CAA) and Clean Water Act (CWA) permitting for all types of new and existing sources, such as electric utility power plants, cement and lime kilns, pulp and paper plants and textile manufacturing plants; Resource Conservation and Recovery Act (RCRA) and Solid Waste Disposal Act (SWDA) permitting for solid and hazardous waste treatment, storage and disposal facilities; and RCRA closure plans and closure permits for contaminated lands problems.
· Environmental Aspects of Corporate Projects and Transactions - Due diligence and document negotiations related to purchase and sale of steam-electric generating stations, cement manufacturing facilities and fiberglass manufacturing facilities; Greenfield project development work on power plants, lime kilns and processing plants and pulp and paper manufacturing plants.
· Environmental Compliance - Counseling and administrative litigation on all aspects of CAA and CWA compliance; Superfund site response and PRP Group management and negotiation; Solid waste landfill permit compliance counseling; Pesticide registration and regulation under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and related state statutes; RCRA contaminated lands response and administrative representation; counseling, administrative representation and litigation regarding Emergency Planning and Community Right-to-Know Act (EPCRA), Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) release reporting obligations.
Mr. McKinney is also very active in the ABA Section on Environment, Energy and Resources, serving as Chair of the 10,000-member Section.
