Sydney McDole focuses on a wide variety of substantial business litigation matters. She has experience in insurance coverage, product liability, oil & gas, financial institutions, trademark and copyright infringement, and major business disputes involving claims of commercial fraud, trade secrets, and breach of contract. She has successfully tried cases in state and federal courts throughout the country and headed AAA and ICC arbitration matters in commercial disputes.
For example, with two other Jones Day partners, she tried a major case for a subsidiary of Hanson PLC against Lloyd's of London in Pittsburgh for failure to provide insurance for groundwater contamination, which resulted in a jury award of more than $70 million. Sydney successfully handled another major insurance coverage case for Occidental Chemical Corporation against several dozen insurers concerning Love Canal in New York. She and two other partners won a large jury verdict in a trademark case for Simon Property Group in Indianapolis. Sydney headed the defense team in Ballinger v. Brush Wellman in Colorado, a product liability case involving chronic beryllium disease in which the jury returned a complete defense verdict. She headed an ICC arbitration for a subsidiary of Occidental Petroleum Corporation involving oil rights in Yemen. After a hearing, the panel unanimously ruled in Occidental's favor on all liability issues. The dispute was settled for $140 million before the damages phase was tried. Sydney successfully defended multiple suits against Ocwen Loan Servicing involving claims of fraud and wrongful foreclosure.
