Kathleen McAchran represents employers in all aspects of employment law, including discrimination and harassment, wrongful discharge, wage-hour, contract, and traditional labor law in state and federal courts, arbitrations, and administrative agency proceedings. She has successfully defended cases regarding discrimination based on age, race, sex, national origin, disability, and religion and has significant experience with single plaintiff and class action cases in these areas. Recently, she has also focused on defending employers in wage-hour class actions alleging that employees were misclassified as exempt from overtime pay requirements and/or worked hours "off-the-clock" for which they were not paid. Her clients range from start-up companies to large multinational corporations, financial and banking institutions, and entertainment and media organizations.
Kathleen also provides day-to-day advice to businesses on a wide range of employment-related issues, including harassment and discrimination, wage-hour issues, enforcement of restrictive covenants, and employment issues in the context of the sale or acquisition of a business. As part of her counseling practice, she works with clients to create employee handbooks and policies and draft executive employment, retention, and separation agreements. In addition, she writes and speaks to professional organizations, law firms, and in-house legal departments on such topics as sexual harassment and wage-hour law and conducts training for managerial and staff-level employees on these and other issues.
Prior to coming to New York, Kathleen worked in the employment law department at Paul, Hastings, Janofsky & Walker in Los Angeles. She is a member of the American Bar Association and its Labor and Employment Section and is a member of the board of trustees of the American Place Theatre.
