Mark Matuschak is a partner in the firm's Litigation/Controversy Department, and a member of the Intellectual Property Litigation and Appellate and Supreme Court Litigation Practice Groups. He joined the firm in 1985.

Mr. Matuschak has more than 20 years of trial experience and practices in the area of intellectual property litigation, focusing on patent, trade dress and trademark cases.
Recent Highlights
- Obtained a jury verdict of patent noninfringement and invalidity for a software company in the United States District Court for the Eastern District of Texas, the first jury verdict of invalidity in this district
- Obtained a jury verdict of trade dress validity and infringement involving small gasoline engines for a large power equipment manufacturer in the Northern District of Mississippi
- Successfully represented a well-known California handheld device manufacturer in obtaining summary judgment of patent invalidity in a case involving handwriting recognition in the US District Court for the Western District of New York
- Obtained a unanimous decision of a three-arbitrator panel in California in a patent dispute involving tunable lasers and filters for fiberoptic networks
- Obtained a jury verdict and prevailed on an equitable claim of dilution in a trademark case for a large paper products company in the US District Court for the Northern District of New York
- Successfully represented a California-based patentee in a Federal Circuit appeal concerning electronic television program guides from an adverse decision
- Successfully reversed a decision in the US Court of Appeals for the Second Circuit following a trial conducted by prior counsel that a key trademark of a group of financial service companies was not protectible and that no likelihood of confusion existed
- Obtained favorable decisions in the US District Court for the District of Massachusetts on all claims following a bench trial involving trademarks used by competing financial institutions for over a century
- Obtained dismissal in Michigan state court of all claims against a large automotive company involving use of the Linux operation system

Mr. Matuschak is a member of the Boston Bar Association, the American Intellectual Property Law Association, and the Dartmouth Lawyers Association.

Mr. Matuschak was named a "New England Super Lawyer" (formerly "Massachusetts Super Lawyer") in intellectual property litigation in the 2004, 2005, 2006, 2007, 2008, 2009 and 2011 issues of Boston Magazine.
