James Martin is a partner in Dickstein Shapiro's Antitrust & Financial Services Practice. Mr. Martin has experience in all aspects of complex antitrust litigation on a national and international scale. Much of Mr. Martin's practice revolves around his representation of major companies, many of them Fortune 500 enterprises, pursuing claims arising out of domestic and international price-fixing and output restriction conspiracies (for example, vitamins, methionine, rubber chemicals, polyurethanes, containerboard, and corrugated boxes). Because of their size and structure, these companies require special attention to help them evaluate their options, formulate and implement strategies to maximize their recoveries, achieve efficiencies, and limit disruptions to their day-to-day operations. Mr. Martin's clients often "opt out" of class actions brought on their behalf in the United States and seek recovery for damages sustained internationally. Mr. Martin has also defended companies accused of antitrust violations and, in one case, served as defense liaison counsel. Mr. Martin represented a group of noted economic professors and scholars as amici curiae before the United States Supreme Court in Empagran v. F. Hoffmann-La Roche Ltd.

In addition, Mr. Martin has experience representing companies victimized by monopolistic conduct.

·         He was a member of the trial team in ZF Meritor LLC v. Eaton Corp., U.S. District Court for the District of Delaware, that obtained a liability verdict for a heavy-duty transmission manufacturer that was squeezed out of the market by exclusive dealing contracts and other anticompetitive actions.

·         He was a member of the trial team in Novell, Inc. v. Microsoft, U.S. District Court for the District of Utah, in an action brought by a prominent computer software provider alleging monopolization of the market for word processing and related software used on personal computers.

·         Mr. Martin was involved in a 20-day International Chamber of Commerce arbitration involving a dispute between pharmaceutical companies.


Mr. Martin has also brought companies before the Department of Justice to apprise the Department of market irregularities and preserve free and open competition in the marketplace.
