Joseph R. Mariniello has practiced law in the State of New Jersey since 1968 and had been the head and heart of the firm since 1972.
Known throughout the state for his landmark cases in the areas of Franchising , Zoning , and Constitutional Law , his private practice has complimented his interests and participation in the public sector. Over the years he has represented such public entities as the cities and towns of North Bergen, Cresskill, and Ridgefield as lead municipal counsel and he currently represents the Town of West New York and Borough of Palisades Park as city attorney. He has over 25 years experience as a municipal attorney.
In the area of zoning he has represented such major developers as Murdoch Developers, Century City, the Japanese leading developer Haseko and Storage U.S.A. His representation includes advice, local approvals and litigation, including low and moderate development. His efforts have helped develop Fort Lee, New Jersey high rise residential section.
On the public side of development he has represented the zoning or planning boards of the Boroughs of Bergenfield, Ridgefield, Fort Lee, Cresskill and currently the City of Englewood Cliffs Zoning Board.
Joseph Mariniello's initial interest in franchising resulted from his personal involvement in unfair termination of gasoline retailers by the major international suppliers. Undaunted by the lack of reported law and initial lack of support he attacked such companies as Shell , Exxon , and Mobil to validate the small franchiser's right to fair treatment under the law. His efforts both in court and before the U.S. Congress validated the New Jersey Franchise Practices Act and moved forward the Federal Gasoline Dealers Franchise Protection Act.
Today many of his clients include franchisers still fighting to protect their businesses from the "mailed fist in the velvet glove" of big business.
Characteristic of Joseph Mariniello's resolve to use the law to promote fairness in his involvement in the Cemetery industry. Driven by a desire to stop unscrupulous cemeteries operators from taking unfair advantage of their fiduciary duties to the deceased, he was instrumental in the enactment and amendments to the New Jersey Cemetery Act, a law guaranteeing rights to the deceased for their perpetual care and guaranteed maintenance of cemeteries in New Jersey. Today he is often consulted by many in this industry and currently represents Flower Hill Cemetery.
