David Marcus is a partner and vice chair of the firm's Litigation/Controversy Department, and a member of the Business Trial Group and the Intellectual Property Litigation Practice Group. Mr. Marcus has more than 20 years of courtroom experience as a lead trial lawyer, both in private practice and as a prosecutor. He has handled numerous lengthy trials, involving matters running from breach of contract and fraud to patent infringement and antitrust.
Mr. Marcus was an Assistant United States Attorney in Los Angeles from 1994 to 1998, where he was a member of the Major Frauds Section. He investigated and tried cases ranging from securities fraud and political corruption to tax fraud and narcotics. From 1999 to 2000, Mr. Marcus served as the Executive Assistant United States Attorney, responsible for the day-to-day management of the 240-lawyer office. From 1992 to 1994, Mr. Marcus was an Assistant Attorney General in Massachusetts, where he tried dozens of cases.
Practice
Mr. Marcus has a general trial practice. He concentrates on intellectual property and commercial litigation. Mr. Marcus has represented clients in patent suits involving microprocessors and software patents in federal courts across the country. He has litigated and tried high-stakes commercial cases in numerous state courts, including Los Angeles County Superior Court. He also represents companies and individuals in connection with criminal investigations by the United States Department of Justice, and has conducted internal investigations for public companies.
Community Involvement
Mr. Marcus serves on the Colby College Alumni Council, and has served as a Director of the Western Center on Law and Poverty.
