Malinowski, Matthew J.

Mr. Malinowski focuses his practice on highly complex, "bet the company" litigation. He has truly worked his way through the ranks at the Firm. Mr. Malinowski started as a front-line litigation paralegal after graduating from college in 1998. He returned as a summer associate in 2001 and 2002. After graduating from law school, he practiced as an associate from 2003 until being elected partner in early 2011. He has defended corporate clients in serial mass tort litigation, including both state and federal multi-district litigation. Mr. Malinowski specializes in the areas of medical device and pharmaceutical products liability defense, high-stakes lost business value and business interruption claims, and putative class action and mass groundwater and soil contamination cases. He also has extensive experience in all levels of litigation, including coordinating massive multi-national and electronic discovery efforts, conducting and defending fact and expert depositions, and drafting Daubert and dispositive motions.

Mr. Malinowski has been heavily involved in some of the Firm's most notable recent cases. He represented a large Firm client in the defense of a substantial lost business value and business interruption case stemming from a train derailment at an industrial plant site, in which the plaintiff company sought hundreds of millions of dollars in alleged damages. In that case, he helped develop deposition and trial cross-examination outlines for the most critical financial and fact witnesses in the case, including the Chief Executive Officer and primary shareholder of the plaintiff company. He was part of the core trial team that was present for the entire trial of that case, which was tried in the United States District Court for the District of South Carolina and lasted one out of an anticipated three months before the parties reached a confidential settlement. Mr. Malinowski also represented a medical device manufacturer in serial litigation involving surgical mesh used to repair hernias, and was part of the trial team for the first jury trial in that litigation, which resulted in a complete defense verdict that was subsequently named one of 2004's Top Ten Defense Wins by The National Law Journal.

Mr. Malinowski works closely with experts in medical, economic, financial, and environmental disciplines, in addition to preparing corporate witnesses for deposition and trial testimony. Mr. Malinowski also has prepared pre-trial mock jury presentations and represented some of the Firm's largest clients in high-stakes mediations. He has been instrumental in the successful resolution of many of the Firm's complex cases, including Daubert summary dispositions and trials.

Mr. Malinowski is a member of the Defense Research Institute, the National Association of Railroad Trial Counsel, and the John Carroll Society.

r. Malinowski works in the Firm’s Pharmaceutical Products and Toxic Torts & Products Liability groups. He focuses his practice primarily in the area of medical device and pharmaceutical products liability defense and associated regulatory counseling, though he has gained broad experience in groundwater and soil contamination cases as well. He works closely with experts in various disciplines, including general surgery and urology.

Mr. Malinowski has been instrumental in the successful resolution of many of the Firm’s complex toxics and medical device cases, including Daubert summary dispositions and trials. He often works on serial litigation, and he has helped clients effectively respond to massive multi-national discovery.
