Timothy N. Toler is a construction lawyer, arbitrator and mediator with 30 years of trial and litigation experience. Tim concentrates his practice in the litigation, arbitration and mediation of complex construction disputes. Over the years, he has represented owners, general contractors, specialty contractors and heavy equipment suppliers on construction claims throughout the U.S. His experience includes a broad range of commercial, industrial, power generation and infrastructure projects.

Tim's approach to the practice of construction law is simple: bring experience, expertise and determination to resolve the dispute cost-effectively for the client. Results do matter, as do the costs of achieving those results. He is honored to have been recognized by his peers with an "AV" rating from Martindale-Hubbell every year since 1993, and by inclusion in Georgia's "Super Lawyers" in the category of Construction Litigation for 2007 through 2012. Tim was recently selected by his peers for inclusion in The Best Lawyers in America 2013 in the field of Construction Law (Copyright 2012 by Woodward/White, Inc., of Aiken, SC).

Tim often represents commercial owners pursuing defective construction claims, and represents general contractors and subcontractors bringing and/or defending against a wide variety of construction-related claims. In 2010, Tim achieved settlement of a commercial developer's defective design and construction claims brought against a segmental retaining wall contractor. The settlement included complete wall remediation and reimbursement to the owner of all expert costs and attorney's fees incurred in the litigation. In 2010, Tim also obtained a $1.2 million summary judgment on behalf of a road-building subcontractor against a general contractor and its surety. The judgment, affirmed on appeal, resulted in the collection of all principal and interest owed under the subcontract.

Tim has represented German companies supplying design and heavy equipment to power plants in the U.S. and abroad. He has served as lead counsel for these companies in litigating, arbitrating or mediating major contract disputes on power generation facilities in Arizona, California, Massachusetts, Texas, Mexico and Malaysia.

Tim received a B.A. in History from the University of Georgia in 1983, graduating Phi Beta Kappa and magna cum laude, with general honors. He received his J.D. degree from the University of Georgia School of Law in 1983, where he served as Chief Justice of the Honor Court and on the Moot Court Board.
