Ms. Jonczak analyzes each of her cases similar to playing a game of chess; while it is important to win the short-term battles, it is even more important to stay a few moves ahead of the opponent in order to win the long-term war. This includes maintaining an ongoing consideration of how a given litigation strategy may impact the setting of legal precedent, settlement, and a judge or jury at trial. Thus, for each case that Ms. Jonczak defends, she takes great care in educating her clients on how to achieve the best result at each phase of litigation in the most cost-effective manner possible.
Since joining the firm in 2010, Ms. Jonczak's practice has remained consistently diverse. For instance, she has tried and won several federal bench trials of claims arising under the Longshore and Harbor Workers' Compensation Act and Defense Base Act. In one case in particular, Ms. Jonczak obtained a complete defense verdict on behalf of the Employer and Carrier, saving her client from well over a million dollars in exposure. The Claimant in that case was a long-term employee on an American military base in the Middle East who sought medical and compensation benefits for "repetitive trauma" injuries to his neck, bilateral shoulders, low back, and left hip. The Employer and Carrier wholly denied benefits throughout the case. The Court agreed with Ms. Jonczak's arguments at trial, holding that Claimant was entitled to zero benefits because he had failed to establish his prima facie case of injury, and that even if he had established his prima facie case, that Employer and Carrier had successfully rebutted same through factual and expert medical evidence. Ms. Jonczak has defended clients in international commercial contract disputes at binding arbitration, presented oral argument to the Third District Court of Appeal of Florida, and reached favorable settlements in high-exposure professional liability and maritime cases. Ms. Jonczak has a particular interest in medical malpractice defense, as several members of her family are in the medical field.
When she is not litigating, Ms. Jonczak enjoys teaching seminars to clients. She has taught courses approved by the State of Florida in the topics of medical malpractice, legal malpractice, bad faith, accountant malpractice, and federal workers' compensation.
Ms. Jonczak received her Juris Doctorate from the University of Florida Levin College of Law in 2008. In 2005, she graduated from the Florida State University with a Bachelor of Science in History and Political Science, Magna Cum Laude with Honors. She is licensed to practice in all county and circuit courts of Florida, as well as the United States District Court for the Southern District of Florida
