David Heffernan is a partner in the firm's Regulatory and Government Affairs Department, chair of the Aviation Practice Group and a member of the European Regulatory Practice Group. He joined the firm in 2000.
Practice
Mr. Heffernan has represented clients, including major US and foreign airlines (both passenger and cargo), before various government agencies and prepared applications for economic authority, code-share authority, international frequencies and routes and antitrust immunity. He also has advised clients on US laws, regulations, legislation and DOT/FAA/TSA policies with respect to such issues as mergers, acquisitions, airline alliances and joint ventures, computer reservations systems, licensing and certification, taxes and fees, airport slots, rates and charges, advertising and consumer enforcement policies, aviation security and competition policy.
Mr. Heffernan has advised clients on the sale, lease and financing of aircraft, engines, and other aviation assets, including large commercial and private corporate aircraft. He also has advised clients on aviation regulatory aspects of mergers, acquisitions and other corporate transactions involving the purchase and sale of aviation companies and assets, as well as aircraft management agreements. These clients include not only aviation-specialist companies, but also large corporations, banks, private equity and other investors. Mr. Heffernan also has advised clients involved in the aircraft maintenance, repair and overhaul (MRO) business for both large commercial and private corporate aircraft. This work has included advice on M&A transactions and commercial agreements between MRO service suppliers and customers.
Mr. Heffernan has advised US and foreign airlines and aerospace companies on US export-import control and embargo matters, including licensing, enforcement and compliance issues and foreign ownership restrictions. He has assisted foreign companies in obtaining clearance by the US government inter-agency Committee on Foreign Investment in the US (CFIUS) of foreign investments in the US aviation, aerospace and defense industries.
In addition, Mr. Heffernan has devoted part of his time to pro bono matters, including advising and representing persons with HIV.
Professional Activities
Mr. Heffernan is Editor-in-Chief of the Air & Space Lawyer, which is published by the American Bar Association's Forum on Air & Space Law. Mr. Heffernan also has served as Sponsorship Liaison to the Governing Committee of the ABA Forum on Air & Space Law.
