He has extensive experience in arbitration, trial, and mediation of large construction, fire subrogation and business. Mr. Roche has recovered numerous multi-million dollar awards for clients, including insurance companies, construction contractors, real estate developers and other businesses.
CONSTRUCTION LITIGATION
- Recovered more than $50 million on behalf of owner developer of five star hotel casino project in Las Vegas, Nevada. This case included multi-million dollar delay, disruption and defective work claims against international general contractor, subcontractors and design professionals.
- Successfully represented general contractor and surety in delay, defective work and wrongful termination claims arising out of construction of municipal airport in Phoenix, Arizona. Recovered virtually all bond payments made by surety and obtained reversal from City of contractor's termination for cause, reinstating contractor's bonding capacity.
- Successfully defended owner developer of Denver's most expensive high rise condominium project against multi-million dollar claims of defective design and construction claims.
- Regularly represent owners, developers, general contractors and subcontractors in complex delay, disruption and defective work disputes.
FIRE SUBROGATION
- Recovered more than $10 million on behalf of insurer in massive house fire involving multi-million dollar home. This fire represented the largest personal lines loss in the history of the company.
- Recovered more than $1.2 million following successful arbitration trial of fire loss caused by defective construction. Arbitration award included 100% of insurance payments made, plus pre-judgment interest and attorneys' fees.
COMPLEX BUSINESS LITIGATION
- Recovered more than $500 million in litigation arising out of the largest estate ever probated in the State of Colorado. Litigated for and obtained reversal of the illegal sale of $600 million in stock by Estate's executors; ousted the original Estate executors and installed clients as new estate representatives.
- Defended multiple class actions on behalf of one of Colorado's largest auto insurers involving numerous coverage and claims-handling issues. Successfully obtained summary judgment and/or denial of class certification in every instance.
- Recovered more than $50 million on behalf of client from two of the nation's largest insurance/insurance brokerage agencies arising out of complex insurance coverage and broker malpractice claims concerning manuscripted "all-risk" umbrella construction insurance.
- Selected by former litigation adversary to serve as general counsel to unsecured creditors' committee in bankruptcy of ENR Top-25 Contracting Firm.
INTELLECTUAL PROPERTY
- Obtained a complete victory in a case before the International Trade Commission, which was brought in 2006 by a large footwear manufacturer alleging that numerous shoe styles infringed its utility and design patents.
- Part of legal team that serves as principal outside intellectual property counsel for the leading retailer in the shoe business in the United States. Part of the legal team that handles patent (utility and design), trademark, trade dress, and copyright issues and all associated litigation, domestic and foreign.
- Represented plaintiff in patent infringement case in Colorado over innovative transdermal measures of testing blood alcohol content.
