Garcia, Jose H.

Robert Galvin is a partner in the Litigation/Controversy Department, and a member of the Intellectual Property Litigation Practice Group. He joined the firm in 2011.

Practice

Mr. Galvin is an experienced trial lawyer whose practice focuses on intellectual property litigation across a range of industries with a particular emphasis on representing innovative companies in the life sciences and software industries. He has tried patent cases in various jurisdictions across the country. Additionally, he has substantial experience advising clients regarding licensing, antitrust and unfair competition issues.

Recent Highlights

• Represented major biotechnology company enforcing patents relating to granulocyte colony stimulating factor against a potential biosimilar competitor in the Eastern District of Pennsylvania. Secured judgment of infringement and permanent injunction, protecting a multi-billion dollar market.
• Represented leading security software company accused of infringing multiple patents relating to network intrusion detection in the District of Delaware. Obtained favorable rulings on summary judgment of invalidity and judgment as a matter of law of noninfringement, which were affirmed by the Federal Circuit.
• Represented leading enterprise software company accused of infringing patents relating to negotiation software in the Eastern District of Texas. Settled.
• Represented a major biotechnology company in Federal Circuit appeal regarding award of priority of invention. Opposing party dismissed appeal after briefing completed.
• Represented major biotechnology company enforcing patents relating to recombinant erythropoietin in the District of Massachusetts against potential competitor. Secured jury verdict and permanent injunction for client, protecting a multi-billion dollar market.
• Represented leading enterprise software company accused of infringing multiple patents relating to procurement in the Eastern District of Virginia. Settled on favorable terms after jury failed to reach agreement on verdict.
• Represented major computer company in antitrust suit against dominant software company, resulting in a $2 billion settlement for client.

Past Experience

Prior to joining WilmerHale, Mr. Galvin was a partner with Howrey LLP, where he focused on intellectual property litigation. Before practicing at Howrey, Mr. Galvin was part of a team that broke from Cooley LLP to form Day Casebeer Madrid & Batchelder LLP in 1998, where he practiced for the next decade. While at Day Casebeer, Mr. Galvin represented both major public companies and smaller private organizations in patent litigation disputes, and had significant trial experience in some of Day Casebeer’s most high-profile cases for some of its most noteworthy clients.

After law school Mr. Galvin was a law clerk for the Honorable Stephen S. Trott of the United States Court of Appeals for the Ninth Circuit.
