Harvey B. Cooper is a partner with the firm. He joined the firm in 1976. Mr. Cooper focuses his practice on wireless communication, employment law, the manufacturing and retail sector and civil litigation.
Mr. Cooper has developed an extensive practice representing wireless telephone carriers and tower companies in site acquisition and zoning. He works extensively with carriers and zoning authorities on wireless site issues and has been involved in both the initial build and upgrading of communication systems. Mr. Cooper also has successfully sued local governments under the Telecommunications Act on behalf of carriers to obtain zoning permits for cell sites. He is a board member of the Nebraska-Iowa Wireless Association.
In his employment practice, Mr. Cooper advises business clients on developing, implementing and monitoring programs for their employment practices. These include federal and state laws impacting the workplace, such as sexual harassment, employee drug and alcohol testing, the Family Medical Leave Act, the American with Disabilities Act, and discrimination in the workplace.
Mr. Cooper has extensive experience drafting employee handbooks, employee policies and procedures, employment applications, and other employment-related forms and communications. He spends much of his time counseling clients on day-to-day employment situations, including hiring, discipline, discharge, discrimination, compensation and related problems. Mr. Cooper also defends corporate clients in discrimination, wage and hour, government contractor compliance, wrongful discharge and other employment matters before administrative agencies and state and federal courts. He is a frequent speaker on these issues at employment related seminars and was a practitioner in residence at Indiana University School of Law teaching employment law.
Mr. Cooper has an extensive background in legal issues affecting manufacturing and retail businesses including drafting and negotiating supply contracts, licenses, leases and other commercial matters.
In his civil litigation practice, Mr. Cooper has litigated many complex litigations involving construction, contract, zoning, RICO and other business matters.
Mr. Cooper received his Bachelor of Arts from Temple University in 1969. After serving as an Intelligence Officer in the U.S. Air Force, he graduated from Creighton University School of Law in 1976 receiving his Juris Doctor degree magna cum laude.
Mr. Cooper is a member of the Omaha Bar Association and the Nebraska State Bar Association. He is on the board of Project Harmony and is a past director of Beth El Synagogue and the Jewish Federation of Omaha. Mr. Cooper has served on the Federal Practice Committee for the United States District Court for the District of Nebraska and on the Executive Committee of the Labor and Employment Law Section of the Nebraska State Bar Association.
