James Prendergast chairs Nelson Levine’s Complex Liability Group. His practice is focused exclusively on litigation matters. Mr. Prendergast most often represents insureds in privacy and data security matters, with particular focus on breaches involving the Payment Card Industry (PCI). He also represents insureds with product liability and toxic tort matters. Mr. Prendergast helps each of his clients succeed by bringing the strategies and tactics learned over twenty years of trial and litigation practice to every file. He brings both the passion of a former prosecutor and the wisdom that comes with experience to every client.
Mr. Prendergast began his legal career as an Assistant District Attorney in the Philadelphia District Attorney's Office, where he tried a large number of criminal cases. In addition to his focus on data privacy and breach cases, he has represented clients in product liability and toxic tort, professional liability, negligence, fraud and wrongful death matters. Mr. Prendergast has tried complex liability matters to juries and judges, and has also represented clients in complex matters to mediators. In addition, Mr. Prendergast has tried serious criminal matters before juries and judges, including first-degree murder.
While in law school, Mr. Prendergast served as a summer law clerk for the Honorable Robert S. Gawthorp, III, of the U.S. District Court for the Eastern District of Pennsylvania. He also served as a summer law clerk for the Philadelphia District Attorney’s Office.
