Bailey, R. Kevin

David Bailey represents companies in complex litigation, with particular focus in recent years on environmental and securities disputes, including mass tort actions and governmental investigations, as well as class actions involving toxic tort, financial, and securities issues. In addition, he has handled a broad spectrum of personal injury, fraud, business tort, regulatory, trade secret, UCC, and defamation matters. He also has defended clients before governmental agencies and arbitration tribunals.

For a chemical industry client, David recently formulated strategy and played a leading role in efforts that defeated certification of an occupational exposure class in a New Jersey toxic tort case filed against multiple defendants. He had similar success defending a paper manufacturing client against class allegations in a Florida property damage action. In 2008, he won an arbitral award for a Florida corporation in a tangible net worth dispute arising from an acquisition agreement. For the past five years, David also has served with other Jones Day lawyers in defending technology companies in SEC proceedings and related litigation. He has substantial experience presenting and defending against scientific and accounting evidence, in connection with which he has dealt with a variety of Frye and Daubert issues.

David has more than 35 years of experience in state and federal trial and appellate courts. Over the course of his career, he has argued more than 40 cases in the Supreme Court of Georgia, the Court of Appeals of Georgia, and the U.S. Court of Appeals for the Eleventh Circuit.
