Tim Lui-Kwan is partner in the firm's Honolulu office and is a member of the Corporate & Business Practice Group. He concentrates his practice on regulatory and administrative law. He has represented a broad range of clients in administrative proceedings before regulatory agencies and boards. Prior to joining Carlsmith Ball in 1989, Mr. Lui-Kwan served as the Deputy Planning Director and a Deputy Corporation Counsel for the County of Hawaii. He has also represented parties in complex litigation involving environmental and Native Hawaiian issues. Before becoming an attorney, Mr. Lui-Kwan worked throughout the Pacific Basin as an archaeologist with the Bishop Museum. He was selected by attorney peers for inclusion in The Best Lawyers in America 2013 in the fields of Adminstrative / Regulatory Law and Litigation - Land Use & Zoning.
Representative Matters
Regulatory Assists and represents clients in proceedings before a number of regulatory bodies in Hawaii, including the State Land Use Commission, State Public Utilities Commission, State Land Board, State Water Resource Commission, State Health Planning and Development Agency, State Real Estate Commission and the State Board of Public Accountancy, as well as the Planning Commissions and County Councils of the Islands of Kauai, Maui, and Hawaii.
Public Contracting and Procurement Represents contractors and vendors in state and county procurements, including protest proceedings and administrative appeals.
Land Use and Planning Represents and advises land developers and operators of numerous resort, commercial and residential projects in all phases of project development, land use and planning. Has also worked for and with state governments in developing regional master plans in coordination with large landowners and developers.
Public Utilities Law Advises a broad range of clients, including energy producers, transportation companies and telecommunications firms, on Hawaii's public utility laws. Has represented energy, transportation and telecommunications clients in proceedings before the State Public Utilities Commission.
Independent Energy Producers Assists energy developers and power plant operators, including cogeneration, geothermal and wind farm projects, in regulatory approvals, project financing, business formation and land use.
Health Care Providers Has assisted health care providers, including hospitals and medical practitioners, in securing certificate of need (CON) approvals, corporate formation and restructuring.
