Wells, Andrea M

Evan Weintraub is a partner in our Litigation Department, having joined the firm in 1992. He practices in the area of general commercial litigation, including general breach of contract disputes, employment disputes, partnership disputes, construction, business torts, multi-forum litigation and other forms of complex litigation.

Mr. Weintraub has represented small to mid-sized companies and high net worth individuals in New York federal and state courts, at both the trial and appellate levels and in numerous other state and federal courts throughout the United States. He has also represented clients in AAA and other private arbitrations, as well as in private mediations.

Prior to attending law school, Mr. Weintraub was an auditor for Arthur Andersen & Co. specializing in audits of small to mid-sized companies in a wide range of industries.

Mr. Weintraub received his JD in 1991 from Brooklyn Law School and a BS in Accounting, cum laude, in 1985 from New York University. He is admitted to the bar of New York and the United States District Courts for the Southern and Eastern Districts of New York.

Mr. Weintraub is a member of the New York State Bar Association.

REPRESENTATIVE CASES: 

-Bruno v. Bruno, 2011 WL 1364449 (1st Dep't, April 12, 2011):  Lead counsel on successful motion to dismiss complaint and affirmation of decision on appeal in action by wife against husband and former employer alleging fraud.  The lower court and appellate court held that wife was collaterally estopped from bringing claims in New York.

-Abrams v. Malia Mills, Inc., Index No. 108586/06 (New York Sup. Ct., New York Co.):  Lead counsel in obtaining unanimous jury verdict for defense in action by investor claiming breach of fiduciary duty against officers and directors of closely held corporation.

-400 East 51st Street, LLC v. Fifty First Beekman Corp., 38 A.D.3d 448, 832 N.Y.S.2d 529 (1st Dep't, March 27, 2007):  Lead counsel on successful motion for summary judgment dismissing complaint and affirmation of decision on appeal in action by developer of construction site in Manhattan against owners of adjoining building alleging trespass, nuisance and negligence arising out of construction work performed on facade of the adjoining building.

-Sign Up USA, Inc. v. JCF Associates, LLC, 33 A.D.3d 905, 823 N.Y.S.2d 449 (2d Dep't 2006):  Lead counsel on successful motion for summary judgment and affirmation of decision on appeal in action seeking declaratory judgment that lease between billboard company and landlord was valid and binding agreement.
