Elaine Wallace focuses her practice on litigation and counseling in intellectual property, privacy, and data security matters. She has substantial experience representing clients in disputes involving copyright, trademark, and trade secrets infringement, cybersquatting, state and federal computer access and fraud claims, intellectual property licensing, and unfair competition. Her clients have included established and emerging software, hardware, and e-commerce companies, a major social networking site, and a pioneering peer-to-peer file sharing service.
Elaine has successfully represented clients in trial and pretrial proceedings in state and federal district courts, appeals proceedings in state and federal appeals courts, and informal dispute resolution proceedings, including proceedings under the Uniform Domain Name Dispute Resolution Policy (UDRP) of the Internet Corporation for Assigned Names and Numbers (ICANN). She has broad experience in all aspects of discovery, e-discovery, expert discovery, and motion practice. Her recent experience includes substantial motion practice and a one month jury trial in a high-profile copyright infringement case. Elaine also regularly counsels clients on trademark, copyright, and licensing issues, including open source issues. Her pro bono work includes intellectual property counseling and dispute resolution work for a major symphony orchestra and a nationally known ballet company.
Elaine is a member of the International Association of Privacy Professionals (IAPP) and is a Certified Information Privacy Professional (CIPP).
