Steven Lehotsky is a counsel in the Litigation/Controversy and Regulatory and Government Affairs Departments, and a member of the Defense, National Security and Government Contracts, Government and Regulatory Litigation and Appellate and Supreme Court Litigation Practice Groups. He returned to the firm in 2010 after completing a clerkship for The Honorable Antonin Scalia, Associate Justice of the United States Supreme Court.
Practice
Mr. Lehotsky’s practice at WilmerHale focuses on civil litigation and advisory matters regarding state and federal regulations, constitutional law, and statutory interpretation. He has represented clients in the agricultural, telecommunications, Internet, financial services, energy and electricity, and pharmaceutical industries at both the trial and appellate levels in various state and federal courts, as well as the United States Supreme Court. He has substantial experience in complex commercial litigation regarding antitrust, securities and intellectual property matters, including all aspects of trial and appeals.
Mr. Lehotsky previously was a senior associate at the firm from 2004 to 2006 and in 2009. From 2006 to 2009, Mr. Lehotsky served as an attorney-adviser in the Office of Legal Counsel, United States Department of Justice. There he advised officials in the Executive Office of the President and officers, departments, and agencies within the Executive Branch on a broad range of constitutional, statutory, regulatory, and international law issues. In particular, his practice focused on providing legal advice regarding foreign intelligence surveillance and national security matters, cyber security and computer-network operations, the federal government’s response to the financial crisis, economic sanctions and export controls, and energy, environmental, homeland security, and immigration issues.
