BANKRUPTCY
Chapter 7 is designed for debtors who can not pay their debts. In a Chapter 7 Bankruptcy the debtor is discharged of all their debts. However, some debts are not discharged under the law even though they were listed in your Chapter 7 Bankruptcy Petition. For example, debts for student loans, taxes, alimony, support payments, criminal restitution, etc... are not dischargeable. Under certain circumstances a debtor may exempt his property and be able to keep certain property, i.e. car, house, etc...
Chapter 13 is designed for debtors who have regular incomes but who are temporarily unable to pay their debts but would like to pay them in installments over a period of time. Essentially, the debtor presents a plan to the Bankruptcy Court of repayment of either all or a percentage of your debts over a certain number of years.
ESTATE PLANNING
A will is an instrument in which a person makes disposition of his/her property to take effect at the time of his/her death. Wills may be revoked and changed during a person's lifetime.
Trusts can be either revocable or irrevocable and are essentially an instrument that designates a trustee to manage the trust assets for the benefit of the designated beneficiaries. Trusts can be funded during one's lifetime or at the time of death.
Health Care Proxy is a document whereby one person appoints another person to make health care decisions for said person because he/she lacks the capacity do so. Health Care Proxies are recognized in Massachusetts.
A Living Will is a document whereby one states his/her intentions regarding the withholding or withdrawing of life-sustaining treatment. Living Wills are not recognized in Massachusetts.
Durable Power of Attorney is an instrument whereby one person appoints another person to perform certain acts for him/her regarding his/her finances.
