David Kutik tries complex cases across a broad spectrum of issues, including antitrust, unfair competition and trade secrets, product liability and wrongful death, construction disputes, man-made disasters, and the largest probate estates in Ohio. He has successfully defended class actions and served as national coordinating counsel. David has dealt with numerous scientific disciplines relating to products ranging from ultra-thin copper foil to concrete. David also leads the Firm's Ohio energy practice, representing energy companies across the country in matters concerning mining and mineral rights, coal sales, natural gas purchase and transportation contracts, power contracts, stranded cost recovery, antitrust, collection policies, rights of way and personal injuries arising from mining accidents, natural gas explosions, and power line contacts. He has tried rate cases and regulatory matters for gas and electric utilities.

Recently, David defended FirstEnergy Corp. and its affiliates in cases involving the 2003 multistate blackout. He represented Dominion East Ohio, obtaining a $40 million rate increase and more than $100 million for infrastructure improvements. He defended The Sherwin-Williams Company against "public nuisance" claims by municipalities and is currently prosecuting an action for Sherwin-Williams relating to insurance coverage for claims involving lead pigment. He defeated a challenge to financing of a $250 million commercial development. In a pro bono case, David obtained the largest civil penalty in the country against a firm engaged in the unauthorized practice of law.

David is a former president of the Cleveland Bar Association and the MetroHealth Foundation. He is president of the Legal Aid Society of Cleveland.
