Brian A. Kumamoto has extensive experience in complex commercial litigation and arbitration, concentrating on business and contract litigation, creditors' rights, real estate, bankruptcy, and a range of other substantive areas. He also counsels clients to structure transactions and avoid issues that lead to litigation.
During over a decade in practice in national and international law firms, Mr. Kumamoto has served as counsel in complex litigation matters involving breach of contract, lender liability, equipment leasing, receiverships, fraud, real estate purchase and sale disputes, director and officer liability, racketeering, securities fraud, breach of warranty, trade secrets, breach of non-compete and anti-solicitation agreements, unfair competition, employment discrimination, wrongful termination, product liability, construction disputes, homeowner association disputes and business valuation disputes. He has substantial experience in motion practice, appellate practice, arbitration, and injunctive and pre-judgment relief. Mr. Kumamoto has represented a wide range of clients, from large publicly traded companies to successful entrepreneurs.
Representative cases include representation of large luxury automotive dealerships in all aspects of their business operations, representation of buyers and sellers in high-end real property purchase and sale disputes, representation of many large financial institutions in the collection of secured and unsecured debt, successful enforcement of millions of dollars in judgments, serving as regional counsel for a major international tire manufacturer in defective design and mass tire recall litigation, successful representation of the New York Superintendent of Insurance in obtaining a stay of litigation in California; general representation of debtors, bankruptcy trustees, and creditors' committees in Chapter 7 and Chapter 11 cases and successful litigation and arbitration on behalf of a physician and his companies against a publicly traded company from a failed management arrangement.
Mr. Kumamoto received his B.S. with honors from the University of California, Irvine, in 1988, where he was elected to Phi Beta Kappa, and his J.D. cum laude from Cornell Law School in 1991, where he served as an editor of the Cornell Law Review. Mr. Kumamoto is admitted to practice in California and before the 9th Circuit.
