Brian Toohey's litigation practice focuses on attorney malpractice and insurance coverage. He is a frequent seminar speaker and writer on the subjects of lawyer liability, legal ethics, and professionalism. His insurance coverage cases have included claims for product failure, environmental cleanup, and business interruption. In addition, he has successfully resolved major commercial disputes through arbitration and mediation. Brian also serves as a court-appointed mediator in a variety of commercial cases in Ohio's Cuyahoga County Common Pleas Court.
Brian has successfully represented a variety of clients in insurance coverage disputes, both domestic and foreign, resulting in significant recoveries for Cleveland-Cliffs (business interruption), Gliatech (product contamination), and Goodrich Corporation (adhesive product failure), among others. He also has successfully defended lawyers and law firms in a variety of professional liability suits, including claims arising out of alleged errors in estate planning and allegations of conflict of interest.
Brian has served as Jones Day's claims counsel for more than 20 years and now serves on the advisory board of the Miller-Becker Center for Professional Responsibility. Brian chaired the Cleveland Bar Association's Ethics and Professionalism Committee during Ohio's transition from a code state to a rules state and is editor of the "Ohio Legal Ethics Narrative" available on the Legal Information Institute digital library available at www.law.cornell.edu/ethics and through LexisNexis. He is a member of the ABA (Litigation Section), the New York State Bar Association, the Ohio State Bar Association, and the Cleveland Metropolitan Bar Association. He is listed in Who's Who in American Law and Ohio Super Lawyers (professional liability).
