Brad's practice emphasizes all phases of litigation and negotiation related to real property, focusing on commercial transactions, workouts and dispute resolution. His practice concentrates in private equity, hedge fund and real estate litigation, and distressed real estate. Brad also handles contractual and fiduciary duty disputes for large institutional investors, including public funds. His extensive experience in successfully asserting claims and analyzing litigation matters, using negotiation and structuring techniques, give clients an edge in evaluating their rights and options relevant to potential legal disputes.

Brad routinely provides litigation and other legal services for real estate developers and owners such as Hines, Vulcan Real Estate, Wright Runstad & Company, Opus, Walton Street Capital, Emeritus, Madison Development Group, Swedish Hospital Medical Centers, LBA Realty, CamWest Real Estate Development, Goodman Real Estate, Pinnacle Realty Management Co, Pacifica Companies, Triad Development, Touchstone Corporation and Wallace Properties.

Brad has been retained by the firm's public fund clients in complicated securities litigation as an expert to the class action counsel with regard to, for example, analyzing potential claims and legal theories for inclusion in the funds' litigation complaints. These affirmative claims involve hundreds of millions of dollars, pursuing alleged breaches of contract and breaches of fiduciary duties by fund managers, advisors or administrators, claims against third parties such as large accounting firms which conducted fund audits, claims against placement agents related to pay-for-play schemes, and overseeing numerous insurance claims related to construction defect claims in which certain funds had invested and which subsequently led to litigation. Brad is also actively involved in defending public clients in clawback actions brought by trustees in a number of Ponzi bankruptcies, with regard to private equity and hedge fund investments, which have been filed and are pending across the country, including Madoff, Petters and Lancelot. He also assisted New York City Retirement Systems in a fraud related matter incidental to an international investment fund, and was able to successfully prosecute and negotiate an acceptable resolution for our client.

His representative investment/pension fund clients include CalPERS, Seattle City Employees' Retirement System, the New Mexico Education Retirement Board, TIAA, RREEF, Insignia/ESG, The University of Washington Investment Office, the New Mexico Educational Retirement Board, the Iowa Public Employees' Retirement System, Kern County Employees' Retirement Association, the Public Employee Retirement System of Idaho, the City of Dallas Employees Retirement Fund, New York City Retirement Systems and the Sacramento County Employees' Retirement System.
