Egan Kilbane was recruited to Elk & Elk Co., Ltd. in December 2008 after having served as the staff attorney/law clerk for former Ohio Supreme Court Justice Francis E. Sweeney, former 8th District Appellate Judge/former Presiding Judge of the Cuyahoga Common Pleas Court Leo M. Spellacy, and former Cuyahoga Common Pleas Court Judge Harry A. Hanna.
These Judges preside over the mass tort docket in Cuyahoga County, one of the largest State Court dockets in the country devoted to asbestos, silica dust, welding rod fume, vinyl chloride exposure, and similar claims.
Prior to his time with the Court, Egan spent several years working for a high-profile insurance defense firm, giving him an insight into the manner in which liability claims are processed and defended. Egan's practice focuses on claims arising from medical negligence, products liability, auto and trucking accidents, and other general liability scenarios.
Egan earned his undergraduate degree in history and computer applications and a minor in Irish Studies from the University of Notre Dame in South Bend, Indiana. He studied law at the University of Cincinnati College of Law, earning his Juris Doctor in May 2005.
Egan’s practice focuses primarily upon personal injury and wrongful death claims arising from medical negligence, nursing home negligence, products liability and automobile and trucking negligence. For three consecutive years, he has been recognized as an “Ohio Rising Star” by Ohio Super Lawyers, Cincinnati Magazine and Northern Ohio Live. He also received a 4.3/5.0 BV Distinguished Martindale-Hubbell® Peer Review Rating™ by members of the Bar and Judiciary for his legal ability and professional ethical standards.
Settlements and Verdicts:
$120,000 – Nursing Home neglect results in leg fracture, subsequent amputation (November 2010)
Plaintiff suffered a compound fracture from an undocumented fall incident. Complications from the fracture necessitated amputation.
$75,000 – Motor vehicle accident results in serious injuries (March 2011)
Defendant failed to yield at a stop sign, leaving Plaintiff with eye injuries, abrasions on the left side of neck, left arm pain, numbness of the right leg and a back injury.
$55,000 – Slip and fall results in broken hip (February 2011)
Plaintiff slipped on a patch of grease at a restaurant and suffered a hip fracture.
$15,500 – Motor vehicle accident results in serious injuries (February 2011)
Defendant ran a red light, causing the Plaintiff to suffer head injuries, chest contusions, neck and back pain and contusions to both knees.
