Jackie Holmes focuses her practice on complex litigation and on disputes involving federal and state regulatory agencies. Her experience includes defending clients in litigation with federal and state administrative agencies, as well as challenging agency action, including rulemaking, in federal court.
In particular, Jackie has substantial experience in rulemaking and enforcement proceedings under the Occupational Safety and Health Act. Areas of particular focus include ergonomics, lockout/tagout, chemical process safety management, telecommunications regulations, and health standards. She also regularly counsels clients with respect to a broad range of OSHA compliance issues. Jackie represents clients in a variety of industries during all phases of whistleblower actions brought pursuant to the various statutes that OSHA administers, including Section 11(c) of the OSH Act, the Surface Transportation Assistance Act, the Federal Railway Safety Act, and Sarbanes-Oxley.
Jackie also regularly represents clients before other federal agencies, including the National Labor Relations Board and the Equal Employment Opportunity Commission. She has significant experience in unfair labor practice matters, with particular emphasis on refusal to bargain charges, mid-term bargaining issues, and employee benefit matters. She also routinely counsels clients with respect to collective bargaining strategy and contract administration, tries arbitration cases, and handles litigation under Section 301 of the Labor Management Relations Act.
