Malcolm Segal focuses his practice on defending businesses and individuals in white collar criminal investigations and complex civil litigation, including civil and criminal fraud litigation, tax fraud, securities, health care fraud, qui tam litigation  and environmental enforcement matters.  He has long participated in internal corporate investigations, professional and fiduciary liability litigation, employment and tort cases, class action defense, real estate and contract litigation.

 

His clients have included international, regional and local companies, as well as the representation of professionals in business, medicine, the law, real estate, insurance and agribusiness. He regularly represents public and elected officials, legislative agencies, business owners and other individuals in need of counsel.

 

Malcolm, born and raised in New York City, began his legal career as an Assistant District Attorney in the New York County District Attorney’s Office, in New York City, where he devoted his efforts to the investigation and trial of fraud matters. He was later appointed Special Attorney-in-Charge of a United States Department of Justice, Federal Grand Jury Strike Force in Central Texas. After several years of service in Texas, he joined the United States Attorney’s Office in the Northern District of California, in San Francisco, as an Assistant United States Attorney. He was then appointed and served as First Assistant United States Attorney, and as the Chief of the Criminal Division, for the Eastern District of California. He entered private practice, after serving in the government for thirteen years and receiving numerous awards as an outstanding prosecutor.

 

Since beginning his practice, during the past twenty years, he has served as the managing partner of the litigation firm which bears his name and, for a time, was the local managing partner and member of the Board of Directors of a national law firm.  He has been recognized for well over a decade in the Best Lawyers in America, as a Northern California Super Lawyer by San Francisco Magazine and been listed as one of Sacramento Magazine’s Best Lawyers.

 

He has served as an appointed Attorney Representative to the Ninth Circuit Judicial Conference; as an attorney representative to the Eastern District Conference; as an Appointed Member of the Eastern District Civil Justice Reform Act Committee; the appointed Chairperson of the Eastern District Criminal Justice Act Panel; as a Member of the Sacramento Chapter of the Federal Bar Association Executive Committee; and, as a member of the Eastern District Local Rules and Alternative Dispute Resolution Committees. He continues to serve as a Pro-Temp Civil Settlement Judge and Member of the Arbitration Panel of the Sacramento County Superior Court. During his career he has been a lecturer on litigation and government enforcement issues for the Federal Bar Association, the Eastern District Conference, the California State Bar and the Continuing Education of the Bar, as well as at local law schools. He has also participated as a judge in various law school moot court litigation and ethics programs and in Operation Protect and Defend, the District’s educational outreach to the Sacramento student community. He is a member of the Sacramento County, Federal and American Bar Associations; the State Bar of California, the State Bar New York, the National Association of Criminal Defense Lawyers, and California Attorneys for Criminal Justice.

 

Among his community activities, he has served on the Advisory Board of Sacramento Child Advocates; on the Board of the Juvenile Diabetes Research Association of Sacramento; as a member of the Board and Board President of Planned Parenthood of Northern California; as well as on various other committees of public and private organizations.

 

Representative Matters:

 

Represented businesses in highly regulated industries, including nationally prominent  wineries, firearms wholesalers and distributors, members of the tobacco industry, insurance brokers, attorneys, securities dealers and other licensees, in federal, state and local inquiries, investigations and litigation.

 

Served as counsel to numerous  health care providers in the defense of federal and state medical and business fraud investigations, including leading a team of attorneys in a nationally followed health care fraud investigation which included state and federal investigations, hundreds of medical malpractice claims, multiple civil qui tam actions, administrative debarment matters, insurance coverage issues and other parallel litigation.

 

Represented numerous individuals and businesses in federal and state tax fraud investigations and prosecutions.

 

Represented international and national agricultural, ranching, manufacturing, construction  and other companies in criminal and administrative inquiries regarding claimed environmental and endangered species violations. and in the defense of criminal prosecutions and civil litigation arising from business activities.

 

Defended corporations, officers, employees and professionals in federal and state class action litigation, including securities fraud, business fraud Represented multi-national and regional corporations in defense of alleged customs fraud, transfers of regulated products and administrative penalty investigations. and RICO allegations.
