Jonathan Paul Dyal practices primarily in the firm's Litigation Section. Jonathan has represented corporate clients on many issues including Business Disputes, Financial Services, FDCPA, FCRA, Identity Theft, Flood Determinations, Defense of Global Warming/CO2, Eminent Domain, Construction Defects, Products Liability, Intellectual Property, Fiber Optics/Land Use and Mass Tort/Land Issues.
In the last few years alone, Jonathan has successfully obtained for clients the following:
September 2011 - Jury verdict of approximately $1,800,000 in favor of client against the Mississippi Transportation Commission in an eminent domain proceeding (Mississippi Transportation Commission offered client $1,020,000 prior to suit);
September 2011 - Negotiated a confidential settlement on behalf of injured pipefitter against a foreign manufacturer sued under the Hague Convention for providing equipment which exploded upon installation;
April 2011 - Jury verdict of $0 in defense of physician client resulting from claims by former partners for breach of covenant not to compete and breach of fiduciary duty. Jury verdict of $1,089,000 on behalf of physician client against former partners resulting from breach of contract;
October 2010 - Bench verdict in favor of client against seller of property involving fraudulent loan transaction;
April 2010 - Bench verdict in favor of physician client against former partner resulting from fraudulent business transactions;
January 2010 - Arbitration award of $57,033,510 on behalf of Mississippi State Port Authority against the Federal Emergency Management Agency (FEMA offered 44 million prior to arbitration);
April 2009 - Jury verdict of approximately $945,000 in favor of client against the Mississippi Transportation Commission in an eminent domain proceeding (Mississippi Transportation Commission offered client $96,000 prior to suit);
February 2009 - Bench verdict of $0 in defense of client from an alleged injury caused by a slot machine;
October 2008 - Bench verdict awarded to client resulting from alleged construction defects (damages and attorneys' fees awarded to client). February 2010, bench verdict was upheld by the Mississippi Court of Appeals in favor of client;
May 2008 - Bench decision in favor of client in defense of an alleged violation of a covenant not to compete;
April 2008 - Successfully argued summary judgment motions in Federal Court resulting in the dismissal of approximately 100 hurricane related property claims pending against client in which 18 wheeler containers were washed ashore during Hurricane Katrina; and
February 2008 - Obtained over $100 million in insurance proceeds for a client against numerous insurance companies resulting from damages incurred during Hurricane Katrina.
Upon graduation in 1998, Jonathan had the honor of serving for three years as a Law Clerk to United States District Court Judge Walter J. Gex III of the Southern District of Mississippi. He subsequently joined Balch & Bingham LLP in June of 2001 and became a partner in January 2005.
