A FEW MOST MEMORABLE AND IMPORTANT UNITED STATES AND ILLINOIS SUPREME COURT CASES

Schlunk v. Volkswagenwerk Aktiengesellschaft, 486, U.S. 694 (U.S. Supreme Court)

Jack Samuel Ring obtained an unanimous 9-0 Decision not normally given by the United States Supreme Court with regard to a landmark case entitled: Schlunk v. Volkswagen, et al.  The Opinion was written by Justice Sandra Day O’Connor for the Court.

Additionally, he was also successful with the Schlunk case before the Circuit, Appellate and Supreme Court of Illinois.

This Decision established the principal that Americans who are injured on United States soil by products designed and/or manufactured overseas may now be able to serve notice of suit and permitted litigation on those foreign designers and manufacturers through their subsidiaries in the United States and thus avoid the Hague Service Convention and the cost and time involved in service of process in a foreign country.  This case is still cited with regard to the issues in this Landmark Decision.  This case substantially protected the citizens of the United States of America with regard to defective products entering the United States.

In point of fact, the Schlunk case is used even at this time at various law schools throughout the United States to study the issues of Service of Process, Civil Procedure, and Jurisdiction.

Wirth v. Industrial Commission, 57 Ill 2d 475 (Illinois Supreme Court)

Jack Samuel Ring appeared before the Illinois Supreme Court and established that recurrent emotional stress and strain at the workplace can lead to a compensable injury, and that such an injury need not be based merely on physical work.

In addition, in a Second Wirth Appeal of this case before the Illinois Supreme Court, it was established that a claimant could obtain interest with regard to an Award received from an Arbitrator in the Industrial Commission of Illinois, from the date of the Award, rather than from the date of the Decision of Review by the Industrial Commission of Illinois.

The aforesaid interest enured to the benefit of the Claimant-Petitioner during the Review process.

Soto v. E.W. Bliss Division of Gulf & Western, Ill App. 3d, 452.N.E. 2d, 572 (1st Dist. 1983).

This case reviewed and addressed the entire field of products liability cases in Illinois, and established that a manufacturer of a full-revolution punch press could be held liable for failing to install a safety device to prevent activation after the stop button is pushed.  This case provided the basis for attorneys to pursue theories for protecting injured workers with regard to defective design and manufactured products.
