Alice Riechers is a partner at Rakoczy Molino Mazzochi Siwik LLP. Ms. Riechers handles a wide variety of complex commercial litigation, pharmaceutical and Hatch-Waxman patent litigation.

Complex Commercial Litigation

Ms. Riechers' work in the commercial litigation area has been diverse. Ms. Riechers has represented numerous clients in various complex commercial matters, including complex contract, tort, and fraud claims, in addition to her experience in the more specialized field of patent litigation. Ms. Riechers' work in this area has given her extensive experience in discovery matters, pre-trial and trial phases of federal and state court litigation, as well as experience at the federal appellate level.

In particular, Ms. Riechers was part of a team that took a complex contract and fraud case to trial in federal court, and successfully appealed the outcome of that case in the U.S. Court of Appeals for the Seventh Circuit.

Patent Litigation

Ms. Riechers’ practice focuses primarily on pharmaceutical patent litigation. She has gained broad experience in this area, including participating extensively in all aspects of fact, damages, and expert discovery, pre-trial and trial preparation, and appellate preparation.

Specifically, Ms. Riechers was a key member of a litigation team which represented the patent holder in a complex patent infringement action related to a top-selling anti-cancer drug, paclitaxel. In that case, Ms. Riechers and her team obtained several favorable summary judgment rulings and defeated each of the opposing summary judgment motions. In addition, Ms. Riechers assisted in preparing briefs and argument for a Markman hearing, which resulted in a favorable outcome for her client. At trial, Ms. Riechers and her team succeeded in having the client's patents upheld as valid and enforceable. In addition, Ms. Riechers was extensively involved in the related appeal before the U.S. Court of Appeals for the Federal Circuit and in the post-trial damages and willful infringement discovery stages.

Ms. Riechers was more recently a key part of an RMMS team that defeated a motion for preliminary injunction, keeping its client’s generic product on the market pending appeal. After briefing and a hearing before the court, RMMS defeated the motion. Ms. Riechers e also was a member of an RMMS team that recently took a complex patent case to trial, and was also extensively involved in the subsequent appeal to the U.S. Court of Appeals for the Federal Circuit.

Prior to joining Rakoczy Molino Mazzochi Siwik LLP, Ms. Riechers was a litigation associate at Winston & Strawn LLP.
