Raczkowski, Mark A.

Mary Beth Deemer's practice focuses on high-profile federal civil and criminal environmental enforcement actions and investigations. She has defended clients against alleged violations of the Clean Air Act (CAA), Clean Water Act (CWA), Emergency Planning and Community Right-to-Know Act (EPCRA), and Resource Conservation and Recovery Act (RCRA). Mary Beth is an experienced Superfund practitioner and has represented clients at numerous sites in a variety of contexts, including unilateral administrative orders (UAOs), government cost recovery actions, administrative settlements, and private cost recovery and contribution actions.

Mary Beth's recent representations include PCS Nitrogen in a federal grand jury investigation into alleged environmental wrongdoing at the company's Louisiana facility, IBM in a Superfund matter in which the government initially declined to pursue other liable parties, and the Japanese majority shareholder of a Florida company under civil and criminal investigation for alleged violations of the CWA and RCRA. She currently is defending a fertilizer manufacturer in an EPA enforcement initiative alleging Bevill amendment violations directed against the phosphoric acid industry.

Mary Beth heads the Environmental, Health & Safety Practice in the Pittsburgh Office. She is a former adjunct professor at Duquesne University (environmental science and management master's degree program). She speaks and writes frequently on environmental topics including development of the Marcellus Shale natural gas play, sustainability, corporate disclosure and shareholder activism in the area of climate change, and the regulation of products containing nano-scale materials.
