Marc has experience in a variety of general litigation matters in federal and state courts. His practice includes complex commercial litigation matters, complex contract disputes, class action litigation, accounting malpractice litigation, federal securities litigation, state tax litigation, trade secret litigation, and general business litigation. Marc has experience with numerous aspects of pretrial, discovery, and motion practice in various jurisdictions, including drafting motions to dismiss, summary judgment motions, and motions in limine. He has taken and defended numerous depositions of fact witnesses. Marc also has examined fact and expert witnesses and cross-examined fact witnesses before an administrative tribunal.
Marc has represented such clients as Kaiser Aluminum & Chemical Corp., DPL Inc., The Dayton Power and Light Company, Appalachian Regional Healthcare, R.J. Reynolds Tobacco Company, and American Electric Power.

• Gramercy Alumina, LLC, et al. v. Kaiser Aluminum & Chemical Corp., et al. — defended Kaiser Aluminum in a breach of contract action related to the sale of Jamaican operations.
• Kmart Creditor Trust v. PricewaterhouseCoopers LLP, et al. — represented creditor trust in multimillion dollar accounting malpractice and breach of contract case.
• Ohio Bureau of Workers' Compensation v. Behrman Capital III, L.P., et al. — represented private equity funds seeking to prevent public disclosure of trade secret information.
• Berco Construction, et al. v. West American Insurance, et al. — represented workers' compensation insurers in class action matter involving consumer fraud and unjust enrichment claims.
Marc is also committed to pro bono service. He and two other Jones Day attorneys represented a man seeking a new trial after being convicted of murder in Kentucky. The team obtained a writ of habeas corpus from the United States Court of Appeals for the Sixth Circuit ordering a new trial because the state trial court violated the Sixth Amendment's Confrontation Clause. In addition, Marc represented a Mexican citizen in his post-Booker resentencing for unlawful reentry into the United States.
