He has represented clients in state and federal courts and before the American Arbitration Association and Financial Industry Regulation Authority. Mr. Pohl is experienced in all phases of litigation, from commencement of an action through discovery, including depositions and motion practice, as well as trial and post-trial submissions. Moreover, through engagements with corporate clients and other professionals, Mr. Pohl has developed an understanding of issues regarding corporate governance and business judgment.
Representative Matters – Mr. Pohl has represented:
- A communications network provider in a contract and product liability dispute with a French telecommunications operator. Litigated all phases of discovery, as well as summary judgment and pretrial motions in limine in this federal court action
- A Connecticut-based hedge fund in a partnership dispute with its general partner. Litigated emergency injunctive actions in New York State Supreme Court and Bahamian court, as well as all phases of arbitration before the American Arbitration Association, including discovery, prehearing submissions, the hearing and post-hearing submissions
- A broker/dealer in connection with a high-profile securities fraud matter, including parallel investigations and lawsuits by state regulators, the Securities and Exchange Commission, a trustee in bankruptcy and private plaintiffs. Conducted extensive discovery, negotiations and motion practice, achieving dismissal of an SEC complaint
- A Chapter 7 Bankruptcy Trustee in the liquidation of multiple debtor businesses. Prosecuted adversary proceedings in bankruptcy court, took depositions, engaged in motion practice and negotiated settlements
- A mortgage finance company in a dispute arising from an intercreditor agreement with a junior lender
- Litigated all phases of discovery and summary judgment in this New York State Supreme Court action.
