Dr. Eileen Falvey's practice focuses on patent prosecution and patent litigation for clients in the biotechnology, pharmaceutical, and medical device sectors. She specializes in strategic counseling and patent portfolio management in connection with technologies such as antivirals and anticancer therapeutics, nutritional supplements, biologics (antibodies, growth factors, and peptide drugs), and recombinant DNA technology. Her extensive experience includes: working with clients to obtain worldwide patent protection and enforce patent rights, conducting due diligence analyses and evaluating intellectual property rights in connection with financing and other business transactions, investigating and resolving inventorship disputes, participating in interference proceedings, and preparing validity, noninfringement, and freedom-to-operate opinions.
Dr. Falvey's litigation experience includes all aspects of trial practice, from pre-suit investigation through trial and post-trial motions. She also has participated in foreign litigations and opposition proceedings before the European Patent Office.
Dr. Falvey worked in the biotechnology and pharmaceutical group of Pennie & Edmonds from 1998 until she joined Jones Day in 2004. Before studying law, she was a member of the faculties of Boston University School of Medicine and the University of Geneva in Switzerland. Her technical background encompasses a broad spectrum of biochemical, biophysical, and genetic techniques, including biochemical analysis of proteins, nucleic acids, and lipids, and all areas of molecular biology and gene expression.
Dr. Falvey is a member of the New York Intellectual Property Law Association and the American Bar Association.
